ACHA Peace Foundation (APF) was established in 2003, by the Association for Communal Harmony in Asia (ACHA). It is intended to serve as a perpetual source of financial assistance to organizations and individuals in their work to promote peace, communal harmony, respect for diversity, and tolerance of differences, through research, education, and/or action projects, especially in South Asia and amongst people of South Asian origin in other places.

A: BYLAWS

 

Section One: Creation & Purpose

 

The Association For Communal Harmony In Asia Board of Directors (hereinafter “ACHA”), under the express provisions of Article II of its Articles of Incorporation, the Mission and Declaration of Commitment contained in its Bylaws, and Articles II and VIII of its Constitution, hereby authorizes and creates the “ACHA Peace Foundation” as a standing committee of ACHA, and a Board of Trustees to administer it.

 

            The purpose of the ACHA Peace Foundation is to set up a perpetual funding entity, which will provide financial assistance to organizations and individuals in their work to promote peace, communal harmony, respect for diversity and tolerance of differences, through research, education, and/or action-projects, especially in South Asia and amongst South Asians, all consistent with ACHA’s Articles of Incorporation, Bylaws, Constitution, and its status as a nonprofit corporation organized under Section 501(c)(3) of the Internal Revenue Code.

 

Section Two: Board of Trustees

 

The Foundation shall be administered by a Board of Trustees appointed by the Board of Directors of ACHA, which Board  of Trustees shall consist of no less than three and no more than seven Trustees, the majority of whom shall be comprised of  persons who have donated $500 or more to the trust fund created herein.  Until such time as a minimum of three such Trustees are appointed, the ACHA Board of Directors shall serve as the Board of Trustees of the Peace Foundation.   Each Trustee shall serve a term of two years, and is eligible for reappointment; provided, however, that each member of the Board of Trustees shall serve at the pleasure of the Board of Directors of ACHA, and may be removed as a Trustee, without cause, at any time by a majority vote of the ACHA Board of Directors.  The Trustees, and their successors, are to hold in trust for the uses and purposes set forth in this document, all funds donated to ACHA, which are denoted for Foundation purposes.

 

Section Three: Investment and Application of Trust Fund and Income

 

            Trustees shall hold the trust fund, including property, if any, and, in their reasonable exercise of  discretion, invest it or parts of it in investments in which Trustees are permitted to invest under the laws of the State of Oregon, or retain the fund, or parts thereof, in cash deposits, and accumulate the income therefrom.  The Trustees shall, from time-to-time and in such amounts as in their discretion Trustees shall deem proper, apply up to 90% of the trust fund income, but none of the principal, exclusively to the charitable uses and purposes ascribed above, at all times consistent with the Articles of Incorporation, Bylaws, and IRS regulations governing ACHA’s qualification as a tax exempt 501(c)(3) organization.

 

            No Trustee shall engage in any act of self-dealing, nor shall the Trustees make distributions at times or in any manner such as to subject the trust fund to taxation under the applicable provisions of the Internal Revenue Code.

 

Section Four: Restrictions on Use of Trust Fund

 

            The trust fund and the income of the trust fund shall be devoted exclusively to the purposes described above and shall in no part and in no event be given or contributed to, or inure to the benefit of, any private person or corporation, contrary to the provisions of Internal Revenue Service Code Section 501(c)(3).

 

Section Five: Gifts to Fund

 

            Any person or organization may, from time-to-time, make additional gifts of money or property to the Trustees for the purposes of  becoming part of the Foundation’s trust fund. 

 

Section Six: Good Faith Duty of Trustees

 

            Trustees shall be chargeable only with the exercise of good faith in carrying out the provisions of the Foundation’s trust.   Trustees shall not, in the absence of bad faith, be responsible or accountable for errors of judgment in making investments or making the contributions and gifts as contemplated herein.

 

Section Seven: Reimbursement and Compensation of Trustees

 

            Trustees shall be reimbursed by ACHA for all out-of-pocket expenses reasonably incurred by them in the administration of the Foundation’s trust fund.  No part of such expenses shall be paid from the Foundation’s trust fund.  No Trustee shall be entitled to receive any compensation for the Trustee’s services, all of whom shall serve without compensation.

 

Section Eight: Decision of Majority of Trustees

 

            The act of a majority of Trustees in all matters pertaining to this Foundation’s trust, including the investment, management, and distribution of funds, shall be conclusive.  Evidence of such majority action shall be in writing, and shall be filed with ACHA’s Board of Directors as soon as reasonably practical thereafter.

 

Section Nine: Appointment of Successor Trustee

 

            In case of the death or resignation of any Trustee, the successor of such Trustee may be appointed by a majority vote of the Board of Directors of ACHA.  Until such time as such successor Trustee is appointed, the remaining Trustees shall have full power to act under and pursuant to this instrument.

 

Section Ten: Gifts Irrevocable

 

            Gifts made in trust through ACHA to the Foundation under this instrument shall be irrevocable.  If it shall be determined by the Internal Revenue Service, subsequent to the creation of this trust, that the trust fund is not exempt from the payment of income tax upon its income, or that the donors to the fund may not be entitled to charitable deductions for income tax purposes for contributions made thereto in the manner and to the full extent provided by the Internal Revenue Service Code, then such gifts as remain in the fund at the time of such determination shall be given by Trustees to a qualified tax exempt charitable organization selected by Trustees to best carry out the purposes of this trust, and this trust shall thereupon terminate.

 

Section Eleven: Separate Accounts and Annual Accounting

 

            The Trustees shall keep the Foundation trust funds in an account or accounts separate from the account or accounts of ACHA, and shall render an annual accounting to the ACHA Board of Directors, which accounting shall be conclusive and binding on all interested parties if no written objection is filed with the Trustees or the Directors within 60 days after the date of Trustees’ accounting.

 

 

B. PROJECT GRANT GUIDELINES

 

ACHA Peace Foundation (APF) was established in 2003, by the Association for Communal Harmony in Asia (ACHA). It is intended to serve as a perpetual source of financial assistance to organizations and individuals in their work to promote peace, communal harmony, respect for diversity, and tolerance of differences, through research, education, and/or action projects, especially in South Asia and amongst people of South Asian origin in other places.

While We Are Open to Other Areas, in General APF Grants Are Designated for:

 

1.     Non-profit organizations registered in or have been formally recognized by the state/province or country, where they are located. Attach a copy of the certificate of registration or official recognition.

 

2.     Non-profit organizations in existence for at least one year. Attach a brief report of the major accomplishments of the sponsoring organization.

 

3.     Projects which are specific and for a limited period of time.

 

4.     Projects which are well-planned

 

5.     Project applications that are accompanied by letter of support by a maximum of four other local organizations. Each letter should clearly describe the specific ways in which the supporting organization will help make the project a success (cash contribution, volunteered labor, donated space or materials, publicity, etc.).

 

6.     Project applications by individuals that meet requirements number 3, 4 and 5 above. Also individual applicants must attach a report of their previous relevant work.

 

APF Typically Would Not Fund (Modified March 22, 2004)

 

1.      Any project that does not promote peace, communal harmony, respect for diversity, and/or tolerance of differences

 

2.      Academic courses, scholarships, awards, and/or fellowships.

 

3.      Projects with high admission fees.

 

4.      Capital Projects. APF does not fund the purchase of land, buildings, renovation, permanent staffing, or museum acquisitions.

 

5.      Lobbying and fundraising activities. APF will not consider any project advocating a particular political, social or religious organization.

 

6.      Project expenses incurred or paid out before an APF grant is made.

 

7.      Any project that materially benefits an APF Trustee, or an ACHA Director or Member

 

How to Apply

 

1.     Complete all the four parts: a) Grant Request, b) Project Grant Narrative, c) Budget Summary and d) Budget Narrative

 

2.     Applications must be received by ACHA office at least three months before the starting date of the project.

 

3.     Application may be typed, printed on a computer, or legibly printed by hand. The requesting organization’s Authorizing Official must sign the original.
